Weighing renewed emergency appeal (No. 26A305); First Circuit denied the government's request September 10

Judge Indira Talwani issued a preliminary injunction September 4 blocking the U.S. Postal Service's new mail-ballot rule for the November 3 midterms. The First Circuit upheld that block September 10, and the Justice Department is now pressing its emergency appeal at the Supreme Court.

For more than a century, states have run their own voter rolls and decided who gets a mail ballot. In March, President Trump ordered the federal government to build one national list and told the Postal Service to mail ballots only to people on it.

Issued 6-3 ruling on June 25, 2026, clearing TPS terminations for Haiti and Syria

On June 25, 2026, the Supreme Court ruled 6-3 in Mullin v. Doe that courts cannot review non-constitutional challenges to TPS terminations. Justice Alito wrote the majority opinion; the three liberal justices dissented.
